Terms and Conditions for Account Servicing & Mobile Communications

Welcome to the digital communication channels and account servicing platforms operated by Lending Alliance Finance Inc and its subsidiaries and affiliates (“Lending Alliance Finance II Inc,”
“LAF,” “we,” “us,” “our,” or the “Company”) These Terms and Conditions govern our mobile messaging services. By affirmatively opting into those services — for example, by providing your mobile number for account alerts or submitting your communication preferences — you agree to be bound by these Terms and Conditions. If you do not agree, you may decline to opt in or opt out of mobile communications at any time as described below.
1. Scope of the Account Servicing & Mobile Communications Program
Lending Alliance Finance Inc. operates an operational mobile notifications and conversational message routing system utilizing Short Message Service (SMS), Multimedia Messaging Service (MMS), and Rich Communication Services (RCS) protocols. This program is strictly transactional and informational; it is completely non-promotional and is not used for marketing rosters.
Program Description & Message Intent: Communication tracks are dedicated strictly to servicing active user applications, existing commercial loan agreements, or lease contracts. Messages may include real-time credit application status updates, payment due reminders, localized service notifications, account safety alerts, and multi-factor authentication codes (one-time PINs / 2FA).
Nature of Consent: By providing your mobile telephone number on an application form, agreement, or online account profile, you authorize Lending Alliance Finance Inc. to distribute operational text alerts regarding your account. Opting into mobile text messaging is entirely voluntary and is not a condition of service or product approval. If you decline to opt in, or if you revoke your consent, your access to our financial products will not be impacted, and you will continue to receive necessary account servicing through alternative channels (such as email or postal mail).
Message Frequency: Message volume is recurring and may vary relative to your specific billing cycles, account activity tiers, and individual direct responses. Operational messages typically average between two (2) and five (5) alerts per week.
Pricing and Mobile Carrier Rates: Lending Alliance Finance Inc. does not impose premium billing fees or subscription charges to access our mobile notifications. However, standard Message and Data Rates May Apply based on your individual wireless contract. You are solely responsible for any messaging or data delivery fees levied by your mobile provider.
2. Opt-Out (STOP) and Customer Support (HELP) Frameworks
You maintain full control over how we contact you. Clear, automated self-service keywords are always available:
How to Revoke Consent (Opt-Out): To stop receiving mobile text or RCS communications from us, reply to any message sent by our platform with the single keyword STOP, QUIT, CANCEL, UNSUBSCRIBE, or END. Our system will immediately process your command and issue a single final text certifying your request. Following confirmation, all automated outbound texting to that number will cease unless you explicitly re-initiate an opt-in request. Your opt-out mechanism remains accessible and active for at least 60 days following your last message interaction.
Accessing Support (HELP): If you encounter technical failures, receive an unexpected notification, or require account assistance, reply directly to any of our messages with the keyword HELP, or contact our customer team using the corporate details provided below.
3. Network Delivery Disclosures and Liability Exclusions
Mobile wireless carriers (including but not limited to Rogers, Bell, Telus, and associated Canadian telecom providers) and Lending Alliance Finance Inc. operate separate infrastructure networks. Consequently, neither the Company nor the mobile carriers are legally liable for delayed, blocked, intercepted, or completely undelivered alerts resulting from localized wireless network congestion, device-level delivery failures, or dropped signal coverage.
4. Privacy and Data Sharing Rules
All consumer details collected via our mobile communication frameworks are governed explicitly by our company policies. Your mobile phone number, personal opt-in records, and texting consent details will never be leased, sold, rented, or distributed to non-affiliated third parties for marketing or promotional actions. Data is shared exclusively with our technical communication aggregators and critical infrastructure vendors solely to deliver our transactional account notifications, or as strictly mandated by law.
5. Governing Law
These Terms and Conditions, and all operational communication systems managed hereunder, are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law.
